ACTION PACK AND SHIP USAGE TERMS 1. The estimate provided by Action Pack and Ship (APS) is based on information provided by customer (you) and/or information gathered or estimated by APS. It is important that customer provide APS with accurate information regarding what items are being shipped including the dimensions and weight. More accurate dimensions and weight will provide a more accurate estimate. Additional charges may apply. APS will not be held responsible for unforeseen costs associated with customer estimate. 2. Customer must provide APS with accurate contact information. APS will not be held responsible to verify information for the origin or destination including contact person, address and phone number. APS will not be held responsible for additional costs that come from misinformation. APS will not be held responsible for mistakes made from reading customer's submitted shipping forms including but not limited to addresses, phone numbers, names, insurance requests, etc. 3. All estimates are based on ground floor and easy access. It is the customers responsibility to discuss anything other than ground floor/easy access with an APS agent. Additional charges may apply depending on a case by case basis. 4. Truck freight pricing is different for a business or residential pickup and/or destination. Customer must supply APS with accurate information for origin and destination. Additional prices may apply. 5. Additional charges may apply if the customer changes any information once the shipping forms have been submitted by the customer. 6. It is the customer’s responsibility to make sure all items are picked up at the origin whether customer is present or not. APS is not responsible for what is or is not picked up at the origin. 7. Truck freight pricing may vary due to unforeseen factors. Customer is solely responsible for additional charges due to density, re-classification or re-weigh fees. APS can not be held responsible for these unlikely additional fees. 8. Estimates are based on a one person pickup. Additional charges may apply if additional help is needed at the pickup location. 9. APS can not be held liable for customer, family member or any person injured in any way at the origin or destination for any reason. 10. Estimates are based on curbside delivery/back of truck. Indoor delivery must be scheduled before delivery. Additional charges apply. 11. Missed pickup or delivery appointments may incur additional charges. 12. Customer will not ship any product that is hazardous, perishable, illegal or in any way restricted by the Department of Transportation of the United States. APS is not responsible for customer’s negligence. 13. If customer changes any aspect of the job after shipping forms have been submitted additional charges may apply. 14. An estimate represents estimated costs. Customer will not hold APS liable for costs that change or are added as the job unfolds. Customer takes full responsibility for these charges. This includes but is not limited to re-weigh fees, liftgate charges, storage fees, re-classification fees, re-delivery fees, costs due to re-directing a shipment, etc. 15. Customer will not hold APS liable in any way for damages, non-delivery of shipment or loss of profit. APS is a licensed broker. Customer may have a claim with a vendor of APS. APS is not responsible for what a vendor may be liable for to the customer. 16. APS strongly recommends insurance. Our feeling is "when you don't have coverage you need it and when you do have coverage you don't need it." Carriers in the U.S. only pay 10 cents to the dollar for damaged used goods. We recommend cargo insurance. APS is not the insurance provider. APS uses a third party insurance carrier. It is customer's responsibility to get all insurance information from an APS agent prior to shipping. APS will not be held responsible for what a customer assumes is covered. 17. If customer shipment arrives with damage to the packaging, customer may refuse the shipment. At the very least, customer must note damage to the packaging (with the driver still present) on the delivery receipt. Contact APS immediately to discuss any claim. Do not dispose of any packaging. It is strongly recommended to take pictures from all angles. If customer delays informing APS more than 3 days of damages it may prejudice the claim. 18. Storage fees may apply for any shipment that sits more than 3 days. This includes but is not limited to awaiting customer approval on the final price based on the actual packed weight. APS will make a reasonable attempt to contact customer but holds no liability for the inability to contact customer directly. 19. Time is of the essence. 20. Shipping only customers may be liable for additional fees after the shipment has been delivered. Customer agrees to allow APS to run additional fees on the credit card provided. If on account customer agrees to pay addtional fees including but not limited to re-weight fees. (ie: customer tells APS their shipment is 4000 lbs and it is actually 4500 lbs). 21. Credit is subject to prior approval before shipping. Please request our credit application. APS reserves all rights in extending credit. Terms are 21 days. Any outstanding invoice greater than 21 days will be charged a 10% penalty and thereafter 2% monthly compounding. Customer agrees that any outstanding balance is in addition to collection fees. 22. Any customer that refuses to approve final costs of their shipment for longer than 30 days from the pickup date will forfeit their rights to the entire shipment. APS will donate or dispose of the shipment in any way APS deems fit in order to limit APS' losses. Customer will not hold APS liable for non-action on customer's part.
